We are suppliers of laboratory equipment and scientific instruments, completely distinct from any pharmaceutical entity named Apex Laboratories.
• “Customer”, “Buyer”, or “You” refers to any individual, educational institution, research entity, hospital, diagnostic center, or corporate body placing an order or using this website.
• “Products” refers to scientific instruments, 3.3 Borosilicate glassware, plasticware, histology supplies, and chemical reagents listed on our platform.

2. Product Specifications and Commercial Use

As a specialized manufacturer, Apex Labs continuously updates its product lines to maintain technical accuracy.

• Accuracy of Data: While we strive to ensure that all dimensions, volumetric capacities (such as milliliter or inch adjustments), and technical specifications are exact, minor design iterations may occur. Standard laboratory wash bottles, crimp vials, and environmental monitoring devices will meet or exceed the listed technical standards.
• Intended Use: All products sold by Apex Labs are intended strictly for professional research, educational laboratory experiments, clinical diagnostics, and industrial testing. The buyer assumes all responsibility for handling hazardous chemical reagents or operating electrical instrumentation (e.g., centrifuges, heating mantles) according to safe laboratory protocols.

3. Quotations, Tenders, and Pricing

• Price Validity: Prices displayed on the website or in downloadable catalogs are indicative and subject to change without prior notice due to fluctuations in raw material costs (such as Borosilicate glass or specialized electronics). Formal written quotations issued via email remain valid for the period explicitly stated on the document.
• Institutional Supply & Tenders: For orders routed through government portals like the Government e-Marketplace (GeM) or institutional bids (such as Banaras Hindu University or IIT-BHU), the specific compliance parameters, Earnest Money Deposit (EMD) regulations, and technical undertakings specified in the respective tender document will override general online terms where a conflict arises.

4. Payment Terms

• All commercial invoices must be settled according to the payment schedule agreed upon during order confirmation.
• For corporate and institutional orders, production or dispatch begins only after receipt of a valid Purchase Order (PO) and any mutually agreed advance payment.
• In the event of transaction disputes involving electronic bank transfers, processing delays caused by banking intermediaries are subject to verification before order fulfillment or refund processing.

5. Shipping, Logistics, and Delivery

We partner with reliable logistics networks and Third-Party Logistics (3PL) providers to ensure safe transit of fragile scientific equipment and chemical components.

Important Breakage & Shortage Policy: Glassware and precision instruments are packed to rigorous transit-safe standards. Buyers are required to inspect shipments immediately upon arrival.

• Transit Liability: Any transit damage, shortages, or delivery discrepancies must be reported to Apex Labs within 48 hours of receipt, accompanied by unboxing photographs or video proof.
• Carrier Delays: While we coordinate closely with our 3PL and courier partners to meet estimated delivery Timelines, Apex Labs is not liable for delayed deliveries stemming from courier manpower constraints, festive backlogs, or regional transport disruptions.

6. Returns, Cancellations, and Refunds

• Custom Orders: Orders involving custom fabrication (e.g., customized glass dimensions, specific laboratory setups, or non-standard instruments) cannot be cancelled or returned once production has commenced.
• Standard Catalog Items: Returns for standard catalog items are accepted only if the product delivered deviates from the approved technical specification sheet or arrives structurally defective.
• Refund Processing: Approved refunds (including EMD reversals or order cancellations prior to dispatch) will be credited back via the original payment route or bank transfer within 5-7 business days after mandatory administrative review.

7. Intellectual Property

All digital content hosted on apexlabs.co.in, including text, optimized product catalog layouts, technical data sheets, graphics, logos, and the Arcsol & Apex Labs brand assets, are the exclusive intellectual property of Kamlesh Mishra (Proprietor, Apex Labs). Unauthorized replication, scraping, or hotlinking of our download files for commercial use on third-party e-commerce platforms is strictly prohibited.

8. Limitation of Liability

Apex Labs shall not be held liable for any indirect, incidental, or consequential damages resulting from the misuse, improper storage, or uncalibrated handling of our laboratory instruments, glassware, or chemical reagents. The maximum liability of the firm for any verified product defect shall not exceed the purchase price paid by the customer for that specific unit.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India. Any legal disputes, notices, or claims arising out of commercial transactions with Apex Labs shall be subject to the exclusive jurisdiction of the courts located in Varanasi, Uttar Pradesh, India.
